CMT manufactures and markets a wide range of high quality tools. Having a well-established, strong dealer network enhances CMT’s brand
recognition and product sales within the market. The development and maintenance of a strong dealer network allows for efficient service,
support and access to product, which in turn increases CMT’s brand loyalty among retail customers. In order for CMT to develop and maintain a
strong dealer network, we have established the following Minimum Advertised Price Policy (“MAP”) which applies to USA Retailers and Dealers.
1. Advertising – MAP applies to all CMT item numbers advertised through any media, including, but not limited to:
Price on retailers’ website up to the shopping cart/checkout
Online shopping centers (e.g. Amazon, eBay, etc.)
Print Media (e.g. inserts, magazines, newspapers, etc.)
Broadcast (e.g. radio, The Internet, TV, etc.)
Direct mailers, Faxes, E-mail and Newsletters electronic or print
Electronic Media – Internet advertising through either their own or any affiliates’ websites, including banner ads, broadcast e-mails,
automatic emailed price lists, and forum posts.
Advertising must include proper description of CMT Items, as well as the entire tool model number. Model number may be omitted only if
the advertisement contains a SKU number that may accurately be cross referenced to the CMT model number.
2. Minimum Advertised Price Policy “MAP” – Resellers of CMT product may not advertise a price lower than the Minimum Advertised Price
(MAP) for that product.
Refer to CMT’s current MAP excel spreadsheet for established Minimum Advertised Price.
3. MAP Violation & Penalty – – If any CMT product/SKU is advertised below the MAP Policy stated in paragraph 2, CMT will consider it to be a
violation of its MAP Policy (“MAP Violation”). MAP Violations will lead to the following actions:
First MAP Violation in calendar year: CMT will notify you by email and you will have three (3) business days to conform with our MAP
Policy. (2020 calendar year used for tracking)
Second MAP Violation in calendar year: A second MAP Violation within the same calendar year will result in the loss of all Rebate
Funds for that Calendar Year. (2020 calendar year used for tracking)
Third MAP Violation in calendar year: A third MAP Violation within the same calendar year will result in your account being closed
for the remainder of that calendar year. (2020 calendar year used for tracking)
4. Value Added Programs – Value added programs will be deemed a MAP Violation when any good is packaged by the dealer with a CMT SKU
and given for free or below their individual retail price, regardless of whether the value added item is a CMT SKU or not. (e.g. CMT MAP for
the item equals $80.00. Advertisement states “Buy item for $80.00 and receive a free 7-1/4” blade).
Internet retailers may, however, advertise that consumers can call or email to obtain the retailer’s lowest price.
Internet retailers also may advertise the availability of coupons for lower sales prices at checkout.
5. Blanket Discount/Rebate Programs – Advertisements with blanket discounts/rebates are a MAP Violation, unless the rebate is offered
by CMT as a manufacturer discount/rebate to all customers, or if blanket discounts/rebates are offered on all manufactures similar tools
being sold.
6. Discontinued Items – If CMT discontinues an item, CMT retains the right to remove the item from any MAP Policy without notice.
7. MAP Changes – CMT reserves the right to add or remove active items to MAP or adjust MAP with a minimum 5-business-day notice to its
customers. CMT also retains the right to modify or terminate MAP guidelines with a 5-business-day notice to its customers.
8. MAP Web-Monitoring– CMT will be using advanced software to monitor advertised daily prices found on the Internet and will be storing
data, including violations electronically during the year.
