REMFLEX Exhaust Gaskets Minimum Advertised Pricing Policy

In order to preserve our high value products, supply chain profit margins and competitiveness in the marketplace,  Remflex Exhaust Gaskets (Remflex, Inc.) is unilaterally instituting a policy of minimum advertised price standards for Remflex products.  This MAP Policy applies to distributors and retailers, including catalogs and internet retailers (“Resellers”) who resell Remflex products to end users in the United States.  This MAP Policy is for the benefit of all Resellers of Remflex Products and will be uniformly enforced.

1. Remflex Exhaust Gaskets periodically sends out price schedules which include the Manufacturer’s Suggested Retail Price (MSRP).  In addition, The MSRP for all Remflex Products are listed and available at all times on our website (www.remflex.com). These prices may be amended or adjusted by Remflex Exhaust Gaskets at any time at its sole discretion.  Each Advertisement of Remflex Products more than 20% below the listed MSRP will be a violation of this MAP Policy.  The MAP Price is also listed under “General Trade” or “MAP Price” on price schedules provided to Remflex distributors and resellers.
2. This MAP Policy applies to all advertisements of Remflex Products including but not limited to internet auctions, print advertisements, electronic advertisements, emails, internet advertisements, catalog media, and any public signage.  This MAP Policy does not include any in-store advertisement that is not distributed to customers.
3. This MAP Policy only applies to advertised pricing.  Resellers may sell products at any price they choose within their Retail location or over the telephone to an individual consumer.
4. This MAP Policy applies to pricing listed on an internet site which is considered the “advertised price”.  Once a Remflex Product has been added to a shopping cart or order it is considered the selling price and is not bound by this MAP Policy. Statements such as “Add to basket to see price”, “Call for price”, etc. are acceptable as long as the advertised (or listed) price is not more than 20% below MSRP.  Discounts which are applied at checkout such as volume discounts or discounts based on the customer’s buying history, which are applied to the entire order do not violate this MAP Policy.
5. This MAP Policy is solely within the discretion and authority of the owner’s of Remflex, Inc.  No employee or sales representative of Remflex, Inc. has the authority to discuss, modify or grant exceptions to this MAP Policy.  Any representation or action by any employee, sales representative or persons not specifically authorized to discuss, modify or grant exceptions to this MAP Policy under this paragraph is unauthorized and invalid.  All questions about this MAP Policy should be directed by email to admin@remflex.com.
6. Intentional violations and/or repeated failures to adhere to this MAP Policy will result in sanctions imposed by Remflex Inc.  The level and execution of these sanctions is at the sole discretion of Remflex, Inc and may include indefinite termination of dealership or distribution of Remflex Products with or without prior warning.  Remflex Inc. does not intend to do business with Resellers who degrade the value and quality of Remflex products.
7. All distributors of Remflex Inc. Products will supply a copy of this MAP Policy to any new or existing reseller of Remflex Products for their records.
8. Remflex Inc will make every effort to monitor and enforce this MAP Policy.  We ask that our supply chain partners help in this effort by reporting violations to Remflex Inc. by email at admin@remflex.com.  All reports with be held in confidence and followed up on in an expedient manner.
